Age Restrictions in Professional Soccer: A Legal and Sports Analysis

This article analyses the legal and labour implications of age restrictions in professional football, focusing on whether regulations designed to promote young talent may unlawfully limit the rights of experienced players. It uses Costa Rica as the central case study, examining the Football Federation’s directive restricting the hiring of players over 28 in the Second Division and ASOJUPRO’s position that such measures violate the constitutional right to work, equality and the prohibition of age discrimination. The article also compares similar debates in Guatemala and Chile, where age limits or youth-minute requirements generated opposition from players’ unions and concerns about exclusion from the labour market.

The article´s central conclusion is that while youth development, competitive balance and commercial objectives are legitimate sporting goals, rigid age-based restrictions are legally problematic when they reduce employment opportunities without objective justification. More balanced alternatives, such as incentives, development programmes and transitional mechanisms, should be preferred over measures that unfairly exclude players who have already built a professional career.
