Football Disputes in Turkey: Jurisdiction Between TFF Bodies and Ordinary Courts

This article analyses the jurisdictional framework for domestic football disputes in Turkey, focusing on the distinction between matters that fall within the Turkish Football Federation’s internal dispute system and those that may be brought before ordinary courts. It explains that Article 59 of the Turkish Constitution protects compulsory arbitration only for decisions concerning the administration and discipline of sporting activities, and not every contractual or financial football-related dispute. The article examines the role of the TFF Dispute Resolution Chamber, the importance of valid party consent for contractual disputes, the treatment of standard arbitration clauses, and the relevance of labour courts for player, coach and technical staff claims.

This article also addresses commercial disputes, agency-related claims, mandatory mediation requirements and the separate jurisdictional route applicable to international disputes before FIFA and CAS. The central conclusion is that Turkish football disputes cannot be classified by the mere fact that they arise in football; their proper forum depends on the legal nature of the claim, the source of jurisdiction, the validity of consent and the applicable procedural route.
